Please read these terms carefully before using NYC Housing Lottery Alerts.

These Terms of Service ("Terms") govern your access to and use of the website nychousinglottery.com and the NYC Housing Lottery Alerts email notification service (collectively, the "Service"), operated by 123 CR SERVICES LLC ("Company," "we," "our," or "us").
By accessing the Site or subscribing to the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Description of Service
NYC Housing Lottery Alerts is an independent, third-party email notification service. We monitor publicly available data from NYC Housing Connect (housingconnect.nyc.gov) via the NYC Open Data API (HPD datasets published by the City of New York) and send email alerts to subscribers when new affordable housing lottery opportunities are detected that match their selected preferences.
We are not affiliated with, endorsed by, or sponsored by the City of New York, the NYC Department of Housing Preservation and Development (HPD), the NYC Housing Development Corporation (HDC), Housing Connect, or any government agency. We do not control lottery listings, eligibility determinations, application outcomes, or waitlist positions.
2. Eligibility
You must be at least 18 years old and a resident of the United States to subscribe to the Service. By subscribing, you represent that you meet these requirements.
3. Subscription and Payment
- The Service is offered on a monthly subscription basis at $2.99 per month.
- Payment is processed securely through Stripe, Inc. We do not store your credit card information.
- Your subscription begins immediately upon successful payment and renews automatically each month on the same date.
- You authorize us (via Stripe) to charge your payment method on each renewal date unless you cancel before the renewal date.
- Prices are in US dollars and subject to applicable taxes.
4. Cancellation and Refunds
- You may cancel your subscription at any time via the customer billing portal link included in your subscription confirmation email, or by contacting us at contact@nychousinglottery.com.
- Upon cancellation, your subscription remains active until the end of the current billing period. You will not be charged for the next period.
- Refund policy: We offer a pro-rated refund if you cancel within 7 days of your initial subscription or a renewal charge and have not received any alerts during that period. Refund requests outside this window are evaluated on a case-by-case basis. Contact us to request a refund.
- Chargebacks or payment disputes initiated without first contacting us may result in immediate termination of your account.
5. Service Limitations and No Guarantee
The Service is provided as a convenience tool. We make no guarantees regarding:
- Completeness — We rely on publicly available data. Not all lotteries may appear in our alerts if they are not published in the source dataset.
- Timeliness — Alert delivery depends on our data polling schedule and your email provider. Alerts may be delayed.
- Eligibility accuracy — The AMI calculator and eligibility estimates on this site are approximate. Final eligibility is determined solely by the lottery's managing agent.
- Lottery outcomes — We have no influence over lottery results, log numbers, waitlists, or application decisions.
- Uptime — We strive for continuous operation but do not guarantee uninterrupted service.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to our systems, databases, or other users' accounts.
- Scrape, copy, redistribute, or resell alert content without express written permission from 123 CR SERVICES LLC.
- Submit false information when creating an account or subscription.
- Interfere with or disrupt the integrity or performance of the Service.
7. Intellectual Property
All content on this site — including text, design, logos, and code — is the property of 123 CR SERVICES LLC or its licensors and is protected by applicable intellectual property laws. Housing lottery listing data is sourced from NYC Open Data and is subject to the Creative Commons Attribution 4.0 license as published by the City of New York.
You may not reproduce, distribute, or create derivative works from our proprietary content without written permission.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 123 CR SERVICES LLC DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, 123 CR SERVICES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING BUT NOT LIMITED TO MISSED LOTTERY DEADLINES, LOST HOUSING OPPORTUNITIES, OR DATA LOSS. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 3 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless 123 CR SERVICES LLC, its members, officers, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your violation of these Terms or your use of the Service.
11. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved exclusively in the state or federal courts located in New York, NY.
12. Changes to These Terms
We reserve the right to update these Terms at any time. When we do, we will update the "Last updated" date above. Material changes will be communicated to subscribers via email. Continued use of the Service after changes constitutes acceptance of the revised Terms.
